TERMS AND CONDITIONS FOR PARTICIPATION

TukTuk Tournament Release of Liability and Media Waiver

I, the undersigned participant, hereby acknowledge that I am voluntarily participating in the TukTuk Tournament organized by Cornish McKeon Pty Ltd, in association with tuktukrental.com. In consideration of being permitted to participate in this event, I agree to the following terms and conditions:

Assumption of Risks: I acknowledge that participation in the TukTuk Tournament involves inherent risks, including but not limited to, injury or death resulting from accidents, collisions, falls, equipment failure, or acts of other participants. I understand and accept these risks and voluntarily choose to participate in the event.

Release of Liability: In consideration of being allowed to participate in the TukTuk Tournament, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue the TukTuk Tournament, its organizers, Cornish McKeon Pty Ltd, and tuktukrental.com, including their respective directors, officers, employees, agents, volunteers, and representatives (collectively referred to as “Released Parties”), from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me or any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in the TukTuk Tournament or while on the event premises.

Indemnification: I agree to indemnify and hold harmless the Released Parties from any and all liabilities, costs, expenses, claims, or judgments, including attorney’s fees and legal expenses, arising out of my participation in the TukTuk Tournament.

Photography and Videography: I grant the TukTuk Tournament, its organizers, Cornish McKeon Pty Ltd, and tuktukrental.com, the irrevocable and unrestricted right to photograph, record, and/or videotape me during the event. I further grant permission for the Released Parties to use my name, likeness, image, voice, and any other identifying characteristics captured in such recordings for any purpose, including but not limited to advertising, promotional materials, social media, or other marketing efforts, without any compensation to me. This right extends to include any and all photos, videos, voice recordings, and any other form of media that you the participant or your team upload or share throughout the event to either the game app, shared communication spaces (such as Whatsapp), or directly with the organizers.

Severability: If any provision or part of this waiver and release of liability agreement is found to be unenforceable or invalid, the remaining provisions shall continue to be fully enforceable.

Governing Law and Jurisdiction: This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the TukTuk Tournament takes place. Any legal actions or proceedings arising out of or related to this agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

I have read this waiver and release of liability agreement carefully and fully understand its contents. I am aware that by checking the box below that says ‘I Agree’ I am waiving certain legal rights, including the right to sue. I agree to this voluntarily, without any inducement, assurance, or guarantee being made to me, and intend my acknowledgment to be a complete and unconditional release of all liability to the greatest extent allowed by law.
